Terms of Service

1. Acceptance of these terms

By accessing GiftSongs or creating an account, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.

2. What the service provides

GiftSongs turns information you provide into personalised lyrics, song recordings and optional digital or physical gifts.

• A private free preview before a song purchase
• Paid song unlocks and MP3 downloads
• Optional video gifts, wall art and Videobooks
• Account, project, order and subscription management

3. Accounts and eligibility

You must provide accurate account information, be at least 13 years old, and have permission from a parent or guardian where local law requires it.

• Keep access to your email account secure
• Do not impersonate another person
• Tell support promptly if you believe your account is being misused

4. Communications and analytics

We send service messages needed to deliver projects, orders and account security. Optional marketing messages may be unsubscribed from at any time.

• Analytics may measure page and feature usage
• Consent can be withdrawn where consent is the legal basis
• Required transactional messages are not marketing

5. Prices, subscriptions and payments

Prices, billing periods and included allowances are shown before checkout. Payments are processed by Stripe and GiftSongs does not store full card details.

• Recurring plans renew until cancelled
• Cancellation stops the next renewal unless stated otherwise at checkout
• Price changes apply only after any notice required by law
• Taxes and delivery charges are shown before payment

Annual subscriptions and cancellation

An annual plan is a prepaid commitment for the period shown at checkout. Cancelling prevents renewal but does not normally create a refund for the unused part of the current term.

• Access continues until the paid term ends unless the account is terminated for misuse
• Mandatory consumer rights in your country are not restricted
• A billing error that blocks cancellation is handled as a refund request from Usage & Billing in your account, or by email to support@giftsongs.app when the order is not listed there

6. Song purchases and refunds

A song purchase is a personalised digital product. You can review the free preview and selected version before paying; once the full song is unlocked or delivered, the purchase is normally final.

• A failed or undelivered generation can be retried or reviewed by support
• Duplicate or incorrect charges are eligible for investigation
• Nothing here removes rights that cannot legally be excluded

Physical products — returns and defects

Videobooks and other personalised physical products are made for a specific order and cannot usually be returned because you changed your mind.

• Check the video, design, recipient and delivery address before payment
• Report damage or a manufacturing defect within 7 days of delivery with photographs
• Where a defect is confirmed, we may repair, replace or refund as required by law

7. Your content

You keep ownership of names, stories, images, audio and video you upload. You give GiftSongs a limited licence to process that content only as needed to provide, secure and support the service.

• Upload only content you have permission to use
• Do not submit unlawful, abusive or rights-infringing material
• You are responsible for reviewing personal details before sharing a finished gift

8. Acceptable use

Do not interfere with the service, bypass payment or usage limits, scrape private content, reverse engineer protected systems, or use GiftSongs to harm another person.

9. Intellectual property

GiftSongs owns the service, software, interface and brand assets. Your licence to use a purchased output is personal and non-exclusive unless a separate commercial licence is shown at checkout.

10. Availability and liability

We work to keep GiftSongs available, but generation and delivery can depend on third-party networks and providers. To the extent allowed by law, we are not liable for indirect or unforeseeable losses.

11. Suspension and termination

We may suspend access to protect users, investigate fraud, enforce these terms or comply with law. You may stop using the service at any time and can request account deletion.

12. Changes to these terms

We may update these terms when the service or law changes. The current version and update date will remain on this page; material changes will be communicated where required.
